江西省土地使用权网上交易规则(试行)

第一章总则

第一条为规范土地使用权网上交易行为，维护公开、公平、公正的交易秩

序，根据《江西省土地使用权和矿业权统一网上交易管理办法》，结合我省实际，制定本规则。

第二条本规则所称土地使用权统一网上交易(以下简称网上交易)，是指市、

县国土资源管理部门(以下简称出让人)通过江西省土地使用权和矿业权网上交易系统(以下简称网上交易系统)以拍卖、挂牌方式出让土地使用权的行为。

网上拍卖包括信息发布、竞买申请、拍卖竞价、成交确认、结果公布等程序。

网上挂牌包括信息发布、竞买申请、挂牌报价(竞价)、成交确认、结果公布等程序。

第三条以网上交易方式出让本省行政区域内土地使用权的，适用本规则。

第四条中华人民共和国境内外的法人、自然人和其他组织，符合网上出让公

告中明确的资格条件，均可参与土地使用权网上交易活动，法律法规和规章另有规定的除外。

出让人在出让公告中不得设定影响公平、公正竞争的限制条件。

第五条土地使用权出让方案由市、县国土资源管理部门拟定，并报同级人民

政府批准后组织实施，具体工作由市、县国土资源交易机构承办。

第六条省国土资源交易机构负责网上交易系统的日常管理，制作全省统一的

网上出让公告、交易须知和其他相关文件的格式文本，提供全省统一网上交易服务。

第七条有保密义务的单位和个人，应严格遵守保密规定，不得泄露竞买申请

人信息和土地使用权出让相关保密信息。

第二章信息发布

第八条土地使用权网上出让公告及宗地基本信息应当在中国土地市场网、江

西国土资源交易网、江西省国土资源厅网站公开发布。

网上出让公告可以是单宗地出让公告，也可以是多宗地的联合出让公告。

出让公告应包括以下内容:

(一)出让人和土地交易机构的名称、地址、联系电话;

(二)土地使用权名称、位置、面积、用途、开发程度、规划指标要求、出让年限和建设时间等;

(三)竞买申请人资格要求;

(四)获取交易文件的途径和申请的起止时间;

(五)交易的时间;
