She studied French at Exeter University and then took a job with Amnesty International in London, the human rights group. • The idea for Harry Potter came to Rowling in 1990 during a ride train from Manchester to London. She then went to work on the story. That same year, her mother died, leaving Rowling and the rest of her family heartbroken. It is this loss that shaped the way she wrote about Harry Potter and his dead parents.

On October 31, 2007, J.K. Rowling and Warner Brothers filed a lawsuit against RDR Books over the publication of Vander Ark's Lexicon in book form.[2][3][4] The lawsuit was heard in a New York court on April 14, 2008.[5] Whilst some sources refer to Vander Ark being sued, the lawsuit only actually names RDR books.[6]The lawsuit states,The infringing book is particularly troubling as it is in direct contravention to Ms. Rowling's repeatedly stated intention to publish her own companion books to the series.[7]The result of the lawsuit was that the book could be published, but not in its present form. A modified version of the book was published in 2009. This case went to bench trial in the New York Federal District Court of Judge Robert Patterson on April 14, 2008. In every case they have made changes to ensure compliance. They fall in line. But these guys refused to contact us. They refused to answer any questions. They refused to show us any details."[9]RDR Books retained Lizbeth Hasse, from the Creative Industry Law Group in San Francisco, who recommended that RDR Books also retain a New York trial attorney, David Hammer. Ms. Hasse then asked, a group of intellectual property lawyers at Stanford Law School to help defend RDR Books' right to publish. Fair Use Project Executive Director Anthony Falzone said the Lexicon is protected by U.S. law which has long given people "the right to create reference guides that discuss literary works, comment on them and make them more accessible."[10]On 16 January 2008, Rowling and Warner Bros. filed their full 1,100 page complaint against RDR Books, claiming that the book "compiles and repackages Ms. Rowling's fictional facts derived wholesale from the Harry Potter works without adding any new creativity, commentary, insight, or criticism. Cheryl Klein's [the novels' continuity editor] full index ... Bloomsbury's'comprehensive bible'" and "The 'further material from Ms. Rowling's creative mind'".[12]Patterson refused, but did grant "statements contained in the publications listed in the plaintiffs' response" to Warner Bros. claims.[12]In February 2008, Vander Ark, in an interview with the British fan magazine Ansible, said[13]The book is not simply a cut and paste of the Lexicon website. While I was working on the Lexicon book, I received assurances from several copyright and intellectual property experts that the book we were creating was legal.Vander Ark dismissed Rowling's claim to copyright:Part of the problem all along has been the automatic assumption on the part of many that Rowling has the right to completely control anything written about the Harry Potter world. That's quite a huge power grab on her part and from everything I can tell, not legal. You and I are part of a subculture that lives off the creative work of others. We always try to do that in a legal and respectful way. However, if Rowling manages to extend her reach that far into our subculture, she will choke us off very quickly. The HarryPotter books are full of moral choices and ethical dilemmas, and, ironically, Mr. Vander Ark's actions tend to demonstrate that he is woefully unfit to represent himself as either a "fan of" or "expert on" books whose spirit he seems entirely to have missed."[16]The trial began on 14 April 2008 in the United States District Court for the Southern District of New York, with Rowling testifying on day one and Vander Ark testifying on day two.[17][18] During her testimony, Rowling reiterated her claim that the Lexicon contained minimal commentary and merely recycled her writing, adding nothing other than "facetious asides and etymologies of the easiest kind."[19] Rowling referred to the Lexicon as "wholesale theft of 17 years of my hard work", and criticized it as "sloppy" and characterized by "very little research". In sometimes emotional testimony, Rowling recalled beginning the Potter books when she was an impoverished 25-year-old single mother, nearly coming to tears when saying, "These characters continue to mean so much to me over a long period of time. The closest you could come is to say, 'How do you feel about your children?'" Rowling also revealed that the lawsuit has "decimated her creative work" over the prior month, causing her to cease work on a new novel.[17] In his testimony, Vander Ark said that he too had had reserves about publishing the encyclopaedia and that the publishing company had talked him into it. "It's been difficult because there has been a lot of criticism, obviously, and that was never the intention. ... This has been an important part of my life for the last nine years or so," he said.[18]Wary of the consequences of a legal ruling, the presiding judge, Robert P. Patterson, Jr., urged the parties to settle, saying, "I’m concerned that this case is more lawyer-driven than it is client-driven. The fair use people are on one side, and a large company is on the other side. . . . The parties ought to see if there’s not a way to work this out, because there are strong issues in this case and it could come out one way or the other. The fair use doctrine is not clear."[20]The plaintiffs made their closing remarks on the third day of the trial. Rowling claimed that "This case is about an author's right to protect their creation. If this book is allowed to be published the floodgates will open. Are we, or are we not, the owners of our own work? It's not just my work that is endangered."[21] In addition, she claimed that the Lexicon was "sloppy, lazy" and "filled with errors,"[21]though RDR Books lawyer Anthony Falzone noted that "Copyright law does not permit an author to suppress a book because she doesn't like it."[21]On day three, the two sides reached a limited settlement involving the use of any Rowling endorsements on the book. It was agreed that, shouldit be published, neither her name nor her previous endorsement of the website would be used to promote it.[22]Each side employed a literary expert to testify whether or not the Lexicon had copied text without attribution.[21] RDR hired a literature professor from the University of California, Berkeley, who cited reference guides to The Lord of the Rings and C.S. Lewis’s The Chronicles of Narnia as precedents to the Lexicon's book.[23]David Hammer, lawyer for RDR, claimed that the need for a reference guide was greatest when the work being discussed is most creative, and fantasy is presumably the most creative form of literature.[22]Ms. Jeri Johnson, senior tutor in English at Exeter College, Oxford, spoke as an expert witness in literature for the plaintiffs, decrying Vander Ark's work as unscholarly, and claiming that there was enough material in Rowling's world for serious academic analysis.[23] Rowling's lawyers said that, unlike those guides, the Lexicon consists largely of information taken from the books and contains little interpretation or analysis. RDR's lawyers agreed, but said that such guides can provide other benefits for the reader than analysis.[22]During the trial, Rowling said on the stand, "I never ever once wanted to stop Mr. Vander Ark from doing his own guide, never ever. Do your book, but, please, change it so it does not take as much of my work."[24]However, in an interview with the Chicago Tribune, RDR Books' publisher, Roger Rappaport, said, "That opportunity was never presented to us. The only thing they said was: 'Will you stop the book?'"[24]On 8 September 2008, Judge Patterson decided the case in Rowling's favor, claiming that "because the Lexicon appropriates too much of Rowling's creative work for its purposes as a reference guide, a permanent injunction must issue to prevent the possible proliferation of works that do the same and thus deplete the incentive for original authors to create new works."[25] Patterson awarded the plaintiffs $750 for infringement of each of the seven Harry Potter novels and $750 for infringement of each of two official companion books (i.e., Quidditch Through the Ages and Fantastic Beasts and Where to Find Them); the minimum amount possible, "since the Lexicon has not been published and thus plaintiffs have suffered no harm beyond the fact of the infringement."[25] Patterson was careful to draw a distinction between the Lexicon book and other potential guidebooks, saying, "While the Lexicon, in its current state, is not a fair use of the Harry Potter works, reference works that share the Lexicon's purpose of aiding readers of literature generally should be encouraged rather than stifled".[26]Patterson concluded that, "Because it serves ... reference purposes, rather than the entertainment or aesthetic purposes of the original works, the Lexicon’s use is transformative and does not supplant the objects of the Harry Potter works."[27]However, he also noted that, "The Lexicon’s use of Rowling’s companion books is transformative to a much lesser extent. The content of the companion books takes on the informational purpose of the schoolbooks they represent in the novels. As Vander Ark testified, the companion books are 'essentially encyclopediasalready'."[27]"The transformative character of the Lexicon is diminished, however, because the Lexicon’s use of the original Harry Potter works is not consistently transformative," Pa tterson ruled. Who is Japan T obacco International?Japan T obacco International (JTI) is a leading to-bacco product manufacturer, selling its brands in 120 countries. The international division of the company is headquartered in Geneva, Switzerland. JTI employs approximately 40,000 people around the world at 400 offices, 27 fac -tories, five research and development centres, and five tobacco-processing facilities.Reducing the T esting Burden on Business UsersAs a global organisation, JTI relies on its suite of SAP solutions to keep everything runningsmoothly; from finance to Human Resources, and logistics to manufacturing and distribu-tion. T o reduce the overall risk level when new features or versions are introduced, testing is an important part of the software develop-ment lifecycle. JTI traditionally asked the SAP business users to take responsibility for this, as explained by José Jiménez, SAP Delivery Center T est Management Lead within JTI’s IT Global Development Centre: “T esting used to be a manual effort, involving many SAP users on the business side. We used an in-house developed test management tool, along with a record of test plans and results. As our SAP implementation grew, we were very aware that software testing is not a part of our users’ core job and yet we were asking them to spend more and more time on this effort. We could also see that involving so many users in manual testing makes it an error prone activity and we wor-ried about the quality of our software in the long term.”In a bid to increase efficiency and give the users more time for their core jobs, the team looked at outsourcing regression test execu-tion and introducing functional test automa-tion. SAP and Wipro, the chosen outsource partner, weighed in on the technology selec-tion. After extensive market and vendor re-search, the combined team chose the Micro Focus suite of testing tools, licensed through SAP, to support this effort. Moving from Business UserT esting to Outsourced and Automated T estingThe new test suite covered all relevant JTI busi-ness processes and even though business users were still key to the success, the new process drastically reduced their time involved. “ALM/Quality Center tracks and manages the entire testing process and defects for us, and we introduced automation for 72 percent of all test cases,” says José. “Business users don’t need to execute the tests themselves any-more, but through an automated process they review and approve the test results before the SAP release go-live. We saw an immediate pro-ductivity improvement with our business users spending 68 percent less time on their testing activities. Over the next couple of years, we refined and automated our testing processes even further, and saw another 65 percent im-provement against the new baseline numbers. This time saving means the users can focus on their core job functions.”The integration between the Micro Focus solu-tions makes it far easier to create test plans, assign testers, set deadlines, execute the au-tomated test scripts, and record the results for each test. In Madrid, the team intro-duced a purpose-built campus facility wheretesters from all over the world worked duringa two-month period. ALM/Quality Center re-corded a peak activity of over 600 concurrentusers, not surprising when you imagine that al-most 160,000 functional tests were executed.User Acceptance T esting (UAT) required themost testers and test runs –however it is es-sential to the success of any major project re-lated to core business systems. Through thetesting process 16,200 defects were reportedwith over 98 percent of them fixed before thenew solution went into production.When asked how the SAP S/4HANA migra-tion might have been managed without thesupport of Micro Focus solutions, José says:“All IT projects within JTI are driven by busi-ness requirements. Moving to S/4HANA hadvery clear benefits and so the migration wouldhave happened, but without the Micro Focussolutions our test coverage would not havebeen as extensive and fewer defects wouldhave been caught before production. T eamswould have managed the testing effort throughspreadsheets and emails which is inherentlyerror prone and higher risk, so we were gratefulthat we already had experience with an inte-grated set of enterprise-ready testing solu-tions to support us. The direct collaborationwith Micro Focus really helped our productivity.We were impressed with the level of supportwe received.”Defining a New RegressionT est Scope with Micro FocusAlmost as soon as the S/4HANA environmentwent live the world was hit with COVID-19, andJTI was forced to change its traditional work-ing practices quite drastically, in line with manycompanies around the world. José was pleased to report that therewas no disruption at all during the pandemic,and in fact, it showcased to management thatthere is a more efficient and agile way of work-ing through o ut the software developmentorganisation.After the successful go-live of S/4HANA, theteam’s attention turned to preparing for the an-nual SAP upgrade process. “S/4HANA is a verydifferent and new environment, so the majorityof our existing test scenarios and processesno longer applied, and we used ALM/QualityCenter to define a new regression test scope,”comments José. “We carefully analysed andselected 5,000 tests that were adapted to workin our S/4HANA environment. The test execu-tion was outsourced, and we worked closelywith Wipro testers in India on a mix of auto-mated and manual test execution. We receivedreports for 170 defects which we visualised ona heatmap we created on top of ALM/QualityCenter with Microsoft Power BI. This was reallyhelpful for us as it clearly showed the urgencyand severity of each defect and its potentialimpact on our users, focusing and prioritisingthe resolution process.”Micro Focus—a T rusted Partnerin High-Profile ProjectsThe annual S/4HANA upgrade is a high-profile exercise that requires C-level approval in each of JTI’s legal entities. Having the clear reporting and analytics in ALM/Quality Center to show the comprehensive testing effort and the re-sults is key. For the first upgrade, 52 different CFOs were presented with independently isolated testing results enabling them to con-fidently provide go-live sign-off for over 100 JTI legal entities.José concludes: “Having worked with the Micro Focus testing toolset for a number of years now has helped us mature our processes and create a very tangible asset for us as an organ-isation. At present, there are many reports about the synthesis of boscalid in the literature at home and abroad. In this paper, the synthesis process of boscalid is simply summarized, and the synthesis method of intermediate 4-chloro-2’-aminobiphenyl is also described. On the basis of the existing synthesis method, it is proposed to synthesize 4-chloro-2’-aminobiphenyls from o-bromonitrobenzene through reduction and Suziki coupling reaction with p-chlorobenzoboric acid, and then condense with 2-chloronicotinyl chloride to ob-tain the target product. The total yield is 92% and the purity is over 95%. LLM出国前学术准备

如果没有加精，很可能就沉了，那么觉得有用的人也看不到了。
我从2004年开始上土兔，中间换过三个ID，每个都废话很多，和我天秤的性格很相似，呵呵。
交到很多挚友，有很多现在都经常在一起，也得到过很多帮助。
我不是闲得无聊，只是万事皆因果，赠人玫瑰，手有余香。
打几个字，对我也没什么损失，还可以帮到别人，为什么不做？我读的不是TOP法学院，只是以个人浅显经历，说说大家最关心的LLM学习的细节。
选校问题就不说了，仁者见仁智者见智，每个人情况都不一样。
不管做了什么决定，接着努力就行了，不要想太多。
这些内容，都是我摸爬滚打之前，没有人告诉我的。
一、出国之前的准备很多同学都想知道申请完，拿到offer，出国前的空档该做什么。
我个人认为你可以吃吃喝喝，但是如果你是一个对自己要求很高而且觉得闲得无聊的人，可以适当看看书提高英文。
英文问题是很大的问题，英文问题真的是很大的问题，你上学期的苦苦挣扎都是因为英文问题。
看什么呢？首先，不论是上哪所学校，公司法和合同法一般都会选。
公司法用的教材相差很大，因为公司法每个教授的侧重点不同，所以很可能会发很多补充材料，不适合预习。
但是合同法的rule是固定的，不论谁讲，差别都不大。
我们学校用的是这本书：/gp/product/0735563462/ref=oh_o03_s00_i00_detail s据我所知很多学校都用这本，如果可能可以找来看。
但是你也不可能把整本书看完，太没重点。
我贴一个我们老师的syllabus，你可以按照这个syllabus的体系走，在出国前对合同法有个大致了解，来了就不会感觉太累。
不要问我在国内怎么买到，我不知道。
如果买不到也没关系，你可以从这个syllabus里看到一个框架，在国内看看能买到什么，结合框架有个体系性认识就可以了。
