2. MLC,2006公约由三个相关部分构成:条款、规则和守则。

Identity, Rights, and Obligations2.1 IdentityEmployer hereby agrees to employ Seafarer for the position of [position] onboard the vessel [vessel name] ("Vessel"), owned and operated by Employer.Seafarer hereby agrees to perform the duties and responsibilities of the position of [position] onboard the Vessel.2.2 Rights, Obligations, and PerformanceEmployer shall provide Seafarer with the necessary equipment, tools, and materials required for performing the duties of [position].Seafarer shall diligently and efficiently perform the duties and responsibilities of [position] and shall follow all orders, instructions, and directions given by the Master of the Vessel or any other authorized representative of Employer.Seafarer shall comply with all applicable laws, regulations, and rules related to the performance of his or her duties as [position] onboard the Vessel.2.3 Duration of EmploymentThe employment under this Contract shall commence on [date] and continue until [date], unless earlier terminated pursuant to the terms of this Contract or by mutual agreement of the parties.2.4 Termination of EmploymentEmployer may terminate this Contract for cause upon notice to Seafarer if Seafarer: (i) fails to perform his or her duties in accordance with this Contract or applicable laws and regulations; (ii) violates any of the terms and conditions of this Contract; or (iii) engages in any conduct or activity that is detrimental to the Vessel or Employer.Seafarer may terminate this Contract for cause upon notice to Employer if Employer: (i) fails to comply with the terms andconditions of this Contract; (ii) fails to pay Seafarer the compensation and benefits due under this Contract; or (iii) engages in any conduct or activity that is detrimental to Seafarer.2.5 Breach of ContractFor any breach of this Contract by either party, thenon-breaching party shall have the right to terminate this Contract upon notice to the breaching party and seek any applicable remedies available under law.3. Compliance of Laws and RegulationsBoth parties shall comply with all applicable laws, regulations, and rules of the Flag Administration, port state, and any other relevant authorities related to the performance of the duties of [position] onboard the Vessel.4. 1.1According to the Labor Law of the the People’s Republic of China, no employer is allow to recruit young persons under the age of 16.1.2《中华人民共和国船员条例》规定:申请船员注册,应当具备以下条件:年满18周岁(在船实习、见习人员年满16周岁),但不超过60周岁。
在我国未经船员注册不得上船工作。
1.2 According to the Regulations of the the People’s Republic of China on Seafarers, the applicant for seafarer regulation shall be above 18 year s’ old(16 as for a trainee or probationer) but not more than 60 years’ old. No one is permitted to work on board a ship without seafarer registration.1.3《中华人民共和国未成年人保护法》规定:任何组织或者个人按照国家有关规定招用已满16周岁未满18周岁的未成年人的,应当执行国家在工种、劳动时间、劳动强度和保护措施等方面的规定:不得安排其从事过重、有毒、有害等危害未成年人身心健康的劳动或者危险作业。
1.3 According to the Law of the the People’s Republic of China on Protection of Minors, when recruiting young persons over the age of 16 but under 18, employers shall implement relevant national provisions on the types of jobs, working hours, intensity of work and protective measures, etc., and shall not assign them to any work which is likely to jeopardize their physical and mental health, such as over-strenuous, poisonous or harmful work, etc. 1.4《中华人民共和国海船船上工作和生活条件管理办法》规定:船东不得安排未成年海员从事以下范围的实习和见习工作:1.4 According to the Regulation on Seafarers’ Working and Living Conditions on board of the People’s Republic of China(referred to below as “Condition Regulation”), Shipowners shall not arrange the following practices or trainings for young seafarers over the age of 16 and under 18:1.4.1搬运重物作业;1.4.1 the lifting, moving or carrying of heavy loads or objects;1.4.2进入锅炉、液舱和隔离舱;1.4.2 entry into boilers, tanks and cofferdams;1.4.3置身于有害的噪音和振动中;1.4.3 exposure to harmful noise and vibration levels;1.4.4操作起重机械或其他动力设备或器械,或向操作此类机械的人员发信号;1.4.4 operating hoisting and other power machinery tools, or acting as signalers to operators of such equipments;1.4.5操作系泊中拖缆或锚泊设备;1.4.5 handing mooring or tow lines or anchoring equipment;1.4.6索具作业;1.4.6 rigging;1.4.7恶劣天气中在高处或甲板上工作;1.4.7 work aloft or on deck in heavy weather;1.4.8电器设备维护;1.4.8 servicing of electrical equipment;1.4.9接触有潜在危害的物质,或诸如危险或有毒物质等有害的屋里试剂及收到电离辐射;1.4.9 exposure to potentially harmful materials or harmful physical agents such as dangerous or toxic substances and ionizing radiations;1.4.10清洗厨房机械;1.4.10 the cleaning of catering machinery; and1.4.11操控小艇。
1.4.11 the handling or taking charge of ships’ boats.1.5《中华人民共和国海船船上工作和生活条件管理办法》规定:船东不得安排未成年海员在夜间工作,但是根据国家海事管理机构规定的符合STCW公约的船上见习或者实习要求开展的夜航训练除外。
1.5 According to the Condition Regulation, shipowners shall not arrange any young seafarers to work at night, except for night navigation training for the purpose of practice or training stipulated by the maritime authority in accordance with the requirements of STCW.1.6《中华人民共和国海船船上工作和生活条件管理办法》规定:夜间,指当地时间从21点开始的不少于连续9个小时的时间段。
